MASCOMA AUDIO VISUAL (MAV)
PARTICIPATION AGREEMENT, WAIVER, RELEASE, AND CONSENT

By registering for or participating in any Mascoma Audio Visual (MAV) program, production, event, or activity (“Activities”), you acknowledge and agree to the following:

1. Participation and Risk Acknowledgment

You understand that participation in MAV Activities may involve inherent risks, including but not limited to bodily injury, death, property damage, or other harm. You acknowledge that some risks may not be fully known or anticipated.

By participating, you voluntarily accept and assume all risks associated with these Activities, whether caused in whole or in part by your actions, the actions of others, or the negligence of MAV or its representatives.

2. Release and Waiver of Liability

You agree to release and forever discharge Mascoma Audio Visual (MAV), including its board members, officers, directors, employees, agents, volunteers, affiliates, and insurers (“Released Parties”), from any and all claims, demands, actions, causes of action, costs, expenses, or damages of any kind arising out of or related to your participation in any MAV Activity.

This release applies to all claims, whether known or unknown, including those arising from negligence to the fullest extent permitted by law.

3. Indemnification and Hold Harmless

You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all losses, liabilities, damages, or expenses (including reasonable attorneys’ fees and litigation costs) that arise out of or result from your participation in MAV Activities, regardless of whether caused in whole or in part by the negligence or fault of any Released Party.

4. Media and Talent Release

You grant permission to MAV and its representatives (“MAV Persons”) to photograph, record, film, or otherwise capture your image, voice, likeness, and property (“Material”).

You grant MAV Persons and their successors, licensees, and assigns the non-exclusive right (but not the obligation) to use this Material in connection with MAV programs, including for educational, promotional, advertising, and publicity purposes.

You waive any right to inspect or approve the finished product and release MAV Persons from any and all claims, demands, or liabilities related to the creation, use, or distribution of the Material.

You represent that you are fully authorized to grant these rights.

5. Full Release Acknowledgment

You acknowledge that this agreement constitutes a full and complete release of liability for any injuries, damages, or losses that may be sustained as a result of participation in any MAV Activity.

You further acknowledge that you have carefully read and fully understand this agreement and that you are agreeing voluntarily.

6. Emergency Contact Authorization

You understand that you may be asked to provide emergency contact information. By providing this information, you authorize MAV to contact the listed individuals and to share information about your location, condition, or situation in the event of an emergency.

You acknowledge that this information may also be shared with emergency responders or law enforcement if necessary.

You understand that providing emergency contact information is voluntary, but failure to do so may limit MAV’s ability to respond effectively in an emergency.

7. Minor Participant Acknowledgment

If the participant is under 18 years of age, a parent or legal guardian acknowledges and agrees to all terms outlined in this agreement on behalf of the minor and accepts full responsibility for the minor’s participation.

Agreement Confirmation

By signing, registering, or participating in MAV Activities, you confirm that you have read, understood, and agreed to all terms outlined in this Participation Agreement, Waiver, Release, and Consent document.
